General Terms and Conditions

This General Terms and Conditions relate to the holiday contract between a Customer and the Primepage Ltd trading as 321 Motorcycle Tours, with registered address at 561 Finchley Road, London NW3 7BJ UK (hereinafter referred to as 321 Motorcycle Tours).

Booking and Payment

With submission of the online booking form and payment of the holiday deposit, the customer offers to 321 Motorcycle Tours to bindingly conclude a travel contract. 321 Motorcycle Turs cannot accept a participant without a signed booking form. The contract shall enter into force upon the written travel confirmation from 321 Motorcycle Tours. A deposit of 20% per person is required once booking form is confirmed and invoice has been sent to customer. This deposit secures a place on the touring holiday.

The outstanding payment of the touring holiday price shall be made without any additional request 60 days before the start of the holiday, unless specified otherwise. If full payment is not received by the specified due date, 321 Motorcycle Tours reserves the right to treat the reservation as cancelled and to charge a cancellation fee specified in these terms and conditions. If booking is made within 60 days of arrival date, the full payment for the touring holiday is required.

Accommodation and Food

321 Motorcycle Tours will provide accommodation and breakfast during your touring holiday period. Details of accommodation is shown on 321 Motorcycle Tours website, and it consists of three village houses. Your own bedroom and dining / breakfast area will be located in one of the properties.

We serve Continental and English breakfast. For any other requirements or allergies please do contact us before you arrive.

Motorcycles

321 Motorcycle Tours provides motorcycles as part of the holiday package. The pictures of the motorcycles on this website represent the exact version of the motorcycles provided. Please email or call if you need specific or customization information on exact motorcycle versions.

321 Motorcycle Tours shall endeavour to provide the holiday participant with motorcycle model as shown on website; however, it reserves the right to replace it with a comparable model in case of uncontrollable situations. These include, but are not limited to, technical defect, damage due to an accident, theft or a similar incident.

The holiday period is not interrupted due to damage to the motorcycle by client or the inability of the participant to ride the motorcycle. During the holiday period, 321 Motorcycle Tours is not obligated to replace a damaged motorcycle. In case of a technical defect of the rented motorcycle, the customer undertakes to inform the 321 Motorcycle Tours contact person without delay.

Motorcycle Insurance

All motorcycles are insured with Third party liability insurance and Comprehensive vehicle insurance.

The Third-party liability insurance comes with a mandatory Voluntary Excess of £ 300 deductible from your security deposit when the renter is deemed at fault.

The Comprehensive vehicle insurance comes with Insurance Excess for which 321 Motorcycle Tours takes a security deposit. A security deposit in the amount of £2 000, is to be secured by a credit card or paid in cash to 321 Motorcycle Tours at the time of hand-over of the motorcycle at the beginning of the holiday period. This security deposit shall be reimbursed when the motorcycle is returned undamaged to 321 Motorcycle Tours.

Any damage to the motorcycle up to the insurance excess will be deducted from the security deposit. In case of a loss or theft the renter is responsible for the amount of the full security deposit. GPS unit is not included in the motorcycle insurance and has to be paid in full separately if broken, stolen or lost.

Additional Gold & Platinum Insurance

For a fixed cost of 25 £ per day Gold Insurance reduces your security deposit for the motorcycle, while Platinum Insurance costs 40 £ per day and reduces your security deposit to zero (0 £). Riders must have at least 2 years of riding experiences and must be at least 25 or less than 75 years old to obtain Gold and Platinum Insurance. Riders with less than 2 years of riding experiences are responsible for the full motorcycle value. See the chart below:

Regardless of the insurance, the customer is fully liable:

  • For any damage to the motorcycle caused by the customer or any other driver under the influence of alcohol, drugs or any other substances, which impair the ability to drive.
  • For any damage caused intentionally or due to gross negligence.
  • For any damage if the driver did not hold a valid driver license when the damage occurred.
  • For any damage if the driver escapes from the place of accident.
  • For any damage caused by operating the motorcycle by an unauthorized driver.
  • For lost or damaged GPS unit (if the GPS unit was rented together with the motorcycle).
  • For transfer of the damaged motorcycle back to the rental location.
  • For lost documentation of motorcycle, the client shall pay 80 EUR. if damaged or lost.

Motorcycle Damage

The customer is liable for all the damage to the rented motorcycle, documents, parts and accessories, that occur during the holiday rental period. This includes, but is not limited to, theft or loss, damage due to an accident or operational damage, damage as the result of improper use and damage that reduces the value of the motorcycle. The term “damage” is to exclude reasonable wear and tear. Minor blemishes of paint chips from gravel, stones, and insects are considered normal wear and tear. Damage of scratches caused by an accident, dropping a motorcycle or riding a motorcycle through bushes and off road is not considered normal wear and tear.

In case of damage to the rented motorcycle, the customer is liable for repair costs, recovery and return costs, costs for experts, any reduction in technical and market value.

If 321 Motorcycle Tours has to transport the motorcycle back to its premises due to a damage for which the customer is responsible, the 321 Motorcycle Tours reserves the right to invoice the customer for recovering the motorcycle. The minimum charge is £150 with first 50 kilometres covered; every further kilometre is charged in the amount of £1,50 per kilometre. Distance is calculated in both ways of our journey.

Passport, Visa, Driving License and International Driving License

The customer confirms to possess valid documents, which are required in order to participate in the tour: a passport, at least valid until 6 months after the end of the tour, a visa (where necessary), a national driving license and an international driving license (where necessary).

Customers agrees that representative of 321 Motorcycle Tours can make copies of such documents upon customer’s arrival to holiday destination.

The customer is responsible for complying with passport and visa regulations of the respective visiting countries and takes full responsibility for consequences resulting from his/her non-compliance.

By completing the booking, the customer declares to possess a valid driving license for the duration of the holiday tour and for the vehicle used in the tour. The customer shall inform 321 Motorcycle Tours without delay of any and all changes regarding his driving license which have an influence on tour participation (e.g. revocation of the driving license, etc.). If it turns out after the booking and before or during the tour that the customer does not have a valid driving license, 321 Motorcycle Tours shall be released from its obligation to continue to fulfil the contract by invoicing the cancellation rates indicated in these terms and conditions. In this case 321 Motorcycle Tours reserves the right to not provide the motorcycle and to exclude the customer from participating in the tour. 321 Motorcycle Tours shall not be obliged to reimburse paid services of any kind and shall not be liable for any additional costs which may be incurred by the customer due to this circumstance. UK citizens are not required to have an international driving licence to drive in the European countries.

Change of Participant

The participant of touring holiday may only be changed with 321 Motorcycle Tours agreement and if the substitute person complies with all the conditions for the participation in the touring holiday. The person transferring and the substitute person shall jointly be responsible for the remuneration still outstanding as well as, if applicable, for the additional costs incurred by the transfer.

Cancellation Charge

In the case of a customer cancelling the booking after confirmation, 321 Motorcycle Tours reserves the right to charge the cancellation fee based on the time of the cancellation.

No exception to this policy can be made for any reason.

321 Motorcycle Tours is not required to make refunds once the holiday commences, regardless of the reason for the participant’s inability to complete his holiday tour.

321 Motorcycle Tours Services

321 Motorcycle Tours is responsible for providing the services listed on the company website and according to the local standards. In case of a service not provided or provided defectively, the customer shall notify 321 Motorcycle Tours representative on the spot without delay. If the customer does not comply with this obligation, no claims for damages due to a lack of service or a defectively provided service are possible.

Situations and events beyond 321 Motorcycle Tours control (force majeure) may arise (e.g. road work, natural disasters or bad weather conditions, governmental orders, strikes, riots, war or war-like conditions, epidemics, etc.) which make it necessary for 321 Motorcycle Tours to reschedule or cancel a tour, Motorcycle Tours reserves the right to withdraw without prior notice any part or all of a touring holiday or to make such changes as may be necessary, and the extra cost, if applicable, shall be paid by the customer. 321 Motorcycle Tours does not assume responsibility or liability for any resulting losses, expenses or inconvenience to the participant.

Local Provisions

The customer shall participate in the road traffic of the respective tour destination of his own responsibility and undertakes to observe the provisions of the local traffic regulations. If the customer does not comply with the traffic laws, 321 Motorcycle Tours reserves the right to revoke the contract and remove the customer’s rented motorcycle. All traffic tickets, penalties, administrative fines or similar sanctions, as well as damages to legally protected interests of third parties which are due to the non-compliance with the local traffic regulations, shall be paid by the customer. A service charge of £ 30 per ticket will apply for passing rider’s information to the authorities.

Off-Road Riding

Off-road riding with motorcycles provided by 321 Motorcycle Tours shall not be permitted outside of the itinerary determined by 321 Motorcycle Tours. It shall neither be permitted to improperly use the rented motorcycle. The customer shall fully bear the damages caused by unauthorized off-road riding and an improper use without an excess.

Own Responsibility and Ability to Ride

Different participants take part in 321 Motorcycle Tours holiday tours. Naturally, the riding skills of the individual participants differ, however, if a participant does not have the necessary ability to ride and does not have full control over the motorcycle in order to ride safely, 321 Motorcycle Tours shall be released from its obligation to fulfil the contract. In this case, 321 Motorcycle Tours reserves the right to remove the motorcycle and to exclude the customer from participating in the tours.

Customer’s Conduct and Liability

Participants agree not to cause any damage to natural surroundings or third parties through their actions while riding their motorcycles. Participants agree to observe local traffic laws and practice safe travel practices as described by the guidelines provided by 321 Motorcycle Tours. In the event that a participant repeatedly ignores rules or causes others to feel threatened by their actions, 321 Motorcycle Tours reserves the right to revoke this contract and remove the participant’s rental motorcycle.

The customer is liable for all personal and material damages he culpably causes and holds 321 Motorcycle Tours harmless from all claims of parties in connection with such damages. Damages culpably caused by the customer shall in particular, but not exclusively, be damages which are due to driving errors, a lack of ability to drive and, respectively, improper driving behaviour (e.g. driving with the front wheel coming off the ground, non-compliance with safety distances, driving on walkways, etc.) and driving in a condition impairing the fitness to drive.

The customer shall not be allowed to consume alcohol or take medicine or other substances which influence the ability to drive during the riding day until the motorcycle is parked for the night. This applies also to customers who participate in the tours as passengers. In case of non-compliance, 321 Motorcycle Tours reserves the right to revoke the contract and remove the participant’s rental motorcycle.

321 Motorcycle Tours shall be released from its obligation to fulfil the contract if the customer, despite the warning, within the framework of a holiday tour durably impairs the performance of the holiday tour by grossly improper conduct or if participant’s ability to drive does not suffice. In this case, the participant shall be obliged to compensate the damage to 321 Motorcycle Tours.

It is agreed and understood that 321 Motorcycle Tours, its owners, agents and representatives are not the guardians of the participant’s safety and they cannot be held liable in any way for any occurrence in connection with any activity in connection with the tour which might result in injury, death or other damage to the participant, his property, his family, or heirs. 321 Motorcycle Tours is not responsible for any damage caused to third parties due to the participant’s activities during the tours. The liability of 321 Motorcycle Tours is limited to a total of three times the holiday tour price irrespective of the title/claim.

Weather Conditions

321 Motorcycle Tours makes an effort to schedule its tours at a time when the weather conditions in the respective tour regions are favourable for motorcycling. Many tours pass through areas where weather conditions can change abruptly. 321 Motorcycle Tours does not bear any responsibility for bad weather conditions which might occur; the participant is not entitled to a claim reimbursement for the holiday price in such cases.

Data Protection and Copyright

The photographs and videos produced by representatives of 321 Motorcycle Tours during the holiday tour are the property of 321 Motorcycle Tours under copyright law. 321 Motorcycle Tours shall be entitled to use this material for marketing and advertising purposes, including the images in which the participants can be recognized, without incurring any costs to 321 Motorcycle Tours. Participants who submit their photographs to 321 Motorcycle Tours agree to allow the use of their photographs for marketing and advertising purposes.

Miscellaneous

321 Motorcycle Tours recommends to customers taking out an adequate travel, health and accident insurance policies as well as trip cancellation insurance.

The customer is fully aware of the risks and dangers involved in the outdoor activities like swimming, white water rafting, rock climbing or any other activity potentially suggested as a supplemental activity on the tour and accepts full responsibility for participating in the activities.

Receiving and Returning the Motorcycle

The customer takes over the motorcycle in a good mechanical condition, with all necessary equipment and motorcycle documents. The renter is obliged to return the rented motorcycle at the time and place as agreed, and in the same state the motorcycle was rented with the same equipment and documents.

The motorcycle is delivered and must be returned with a full fuel tank. Otherwise, the renter will be charged for the fuel and refuelling costs according to the valid price list (£ 25 + fuel cost). The renter shall pay for all fuel and oil used in the motorcycle during the rental period.

The Customer is Prohibited From

  • Using the motorcycle for commercial transport of passengers or goods.
  • Taking part in any race, speed test or contest, or vehicle test.
  • Driving on roads of racing circuits and off-road driving.
  • Sub-renting or selling the motorcycle or its parts, equipment and accessories to a third person.
  • Driving while under the influence of alcohol, drugs or any other substances which impair the ability to drive.
  • Overloading the rented motorcycle.
  • Making any technical or optical modifications on the motorcycle.
  • Using the motorcycle for any illegal purposes (e.g., criminal acts, violation of customs, etc.).

The Customer’s Obligations

The customer shall ensure that:

  • The water in the radiator and battery of the motorcycle is maintained at the proper levels.
  • The oil in the motorcycle is maintained at the proper level.
  • The tires are maintained at their proper pressure.

The customer shall ensure that all reasonable care is taken in handling and parking the motorcycle, and that it is securely locked when not in use by locking the handlebar and activating the alarm, if the motorcycle is equipped with one.

Motorcycle’s Breakdown

In case of a breakdown the customer is obliged to notify 321 Motorcycle Tours without delay and follow the instructions for further actions. Repairs necessary on route shall be made by experts only. The charges involved will be refunded upon presentation of the bill for the paid exchange parts and repair service.

Accident and Theft

In case of an accident or a theft the renter is obliged to notify the police and 321 Motorcycle Tours without delay and follow their instructions. The customer shall secure all evidence (e.g., witnesses, track marks, etc.) and record personal data of those involved.

Applicable Law

The contractual relationship of the customer with 321 Motorcycle Tours shall be governed by the Law of The United Kingdom.
